On March 29, 2024, Vietnam MIC officially issued Notice No. 02/2024/TT-BTTTT, stipulating the "List of Products and Goods that May Endanger Safety under the Management of the Ministry of Information and Communications Technology" (Class 2 Goods List). Accordingly, products and goods involving wireless broadcasting and information technology in Appendix 1 and Appendix 2 are subject to national quality inspection, compulsory certification and/or declaration of conformity. The new version includes a number of changes to support businesses, including the temporary suspension of testing under extreme conditions and the addition of exemptions for some self-use imported products from conformity certification. At the same time, Vietnam MIC has also reduced the requirements for destructive test cases in accordance with QCVN 132:2022/BTTTT and QCVN 101:2020/BTTTT for some small batch imports. From May 15, 2024, Notice No. 02/2024/TT-BTTTT will take effect and replace Notice No. 04/2023/TT-BTTTT.
Unlike the previously released draft, which was only a revised and supplemented version, the "Notice on the List of the Second Category of Goods" released by the Ministry of Information and Communications this time is a brand new version. This may be the reason why the official version was released later than expected, because the process of issuing a new notice is more complicated and time-consuming than issuing a revised version.
Main new features of the 02/2024/TT-BTTTT circular
What was revealed in the draft and the meeting
As revealed in the draft and in meetings with the Vietnamese MIC, manufacturers and importers, new aspects of Circular No. 02/2024/TT-BTTTT include significant changes to regulations on products and commodity categories requiring quality inspections, declarations of conformity (SDoC) and Conformity Certification (TAC). These changes are as follows:
1) New standards such as QCVN 55:2023/BTTTT, QCVN 110:2023/BTTTT, QCVN 111:2023/BTTTT will be adopted from May 15, 2024, earlier than the standard’s effective date. (QCVN 117:2023/BTTTT has applied for certification from February 15, 2024).
2) Type approval certificates issued during the period of partial or full suspension of the standard between July 15, 2023 and May 14, 2024 will remain valid until the expiry date indicated on the certificate.
3) Exempt from the application of certain technical specifications that are difficult to measure, such as total radiated power (TRP), total radiated sensitivity (TRS), base station performance, etc.
4) For most products (excluding WiFi access point equipment), testing under harsh conditions (extreme conditions) continues to be suspended until June 30, 2025.
5) For self-use imported batches containing up to three wireless transmission and reception products, certification and declaration of conformity are exempted. This exemption only applies to certain products considered to pose a minimal security risk, such as laptops, tablets, desktop computers and televisions.
6) 5G NR mobile phones need to support both independent (SA) and non-independent (NSA) operating modes, and must support the frequency bands specified in QCVN 127:2021/BTTTT.
7) Re-allowing the use of chassis test results for declaration of conformity SDoC according to QCVN 63:2020/BTTTT, which facilitates the process for products that share the same chassis design but may have different sizes or configurations.
8) Wireless charging devices do not need to be tested according to QCVN 55:2023/BTTTT, thus simplifying the process for manufacturers and importers of these devices.
New content, previously unpublished
9) Manufacturers and importing companies can choose to complete their declaration of conformity documents, conformity certification and quality inspection registration between January 1, 2024 and the effective date of Notice No. 02/2024/TT-BTTTT. They can choose to comply with the provisions of Notification No. 04/2023/TT-BTTTT and Notification No. 10/2023/TT-BTTTT or the new regulations specified in this notification. This provides a transition period for businesses to adapt to the new regulations, while also giving them the flexibility to comply with previous notices if they consider them more beneficial or practical.
10) The "Notice" clarifies the list of commitment documents that are exempted from compliance certification and declaration requirements when importing equipment with WiFi 6E and WiFi 7 technology or importing for self-use. This inclusion is intended to ensure that they comply with the safety and operational standards set out in MIC Notice 08/2021/TT-BTTTT.
11) Compared with the previous version of the notice, some product and trade names have been slightly modified. This may involve clarifying product categories, updating terminology to reflect current industry standards, or correcting any ambiguities that may have existed in previous circular text.
